Avelsa Systems Cloud Service Terms

1. Subject matter

1.1. The Operator (ICOM Consalt LLC) provides users of Avelsa controllers with access to the cloud service: a control panel, remote access to equipment, notifications, and storage of logs and readings.

2. Free provision of the service; no obligation to keep it free

2.1. As of this edition, the cloud service is provided free of charge, as an additional (bonus) service to the purchased equipment.

2.2. The current free provision of the service does not create an obligation for the Operator to provide it free of charge in the future and is not a perpetual commitment.

2.3. The Operator may at any time, at its own discretion: change the scope and functional limits of the service; introduce fees for the service or its individual features; suspend or discontinue the service. The Operator notifies users of material changes (introduction of fees, discontinuation) within a reasonable time by any available means (on the website, in the application, by e-mail).

2.4. Continued use of the service after changes take effect constitutes acceptance of them. If the user does not agree, they may stop using the service; this does not affect the autonomous operation of the equipment (Section 3).

3. Autonomous operation of the equipment

3.1. The Avelsa controller performs its core automation functions autonomously, without a connection to the cloud service (local logic, peer-to-peer interaction, operation without the Internet).

3.2. Unavailability, suspension or discontinuation of the cloud service does not affect the basic operation of the equipment and is not a defect of the product.

4. Provided “as is”; no availability guarantees

4.1. The free cloud service is provided “as is”. The Operator does not guarantee its uninterrupted and error-free operation, any particular availability level (SLA), or the preservation of data within the service.

4.2. The Operator is not liable for interruptions, limitations or discontinuation of the free service, or for related indirect losses.

5. Relation to other documents

5.1. Use of the software is governed by the EULA; personal data processing — by the Privacy Policy. These Terms supplement them with respect to the cloud service.

6. Amendments and governing law

6.1. The Operator may amend these Terms; the current edition is published at avelsa.ru. Governing law — the Russian Federation.
